Whole Foods Settlement Talks Fail

It appears that the settlement talks between Whole Foods and their landlord Wical LP have failed and both parties now seek to schedule a trial date. Whole Foods and Wical have been involved in a dispute and court case over the closing of the Glover Park store and subsequent eviction order for over a year now, and the store remains closed. The two parties filed with the courts a joint status report on on May 24th, 2018 regarding their conference and requesting a schedule for discovery and a trial date. They stated that in their April conference they "determined that settlement does not presently appear possible, but the parties remain amenable to discussion."

The status report puts forth a proposed schedule of discovery, with the furthest deadlines being February 28th, 2019 for expert discovery and March 29th, 2019 for dispositive motions and then responses to those motions by the end of April 2019. The day after the filing of the status report Wical filed a supplemental statement reiterating its claims against Whole Foods and it's position on recent rulings, thus indicating how they plan to pursue the case at trial.
